            APRIL 19, 2005
     

            

The City Council of the City of Thibodaux assembled in regular session at Peltier Hall Auditorium, Nicholls State University Campus, Thibodaux, Louisiana, on Tuesday, April 19, 2005 at 5:00 o’clock P.M.

 

            There were present:  Councilmen Swanner, G. Richard, Winston, Mire and Dee Richard.

 

            There were also present:  Mayor Charles Caillouet and Germaine Jackson.

 

            The minutes of the April 5, 2005 Council meeting were approved as written.

           

            The City Council adopted by acclamation a resolution commending the ED White High School Varsity Volleyball Team for their title of LHSAA 2005 Division III State Runners-Up.  The Mayor and Council presented certificates to the Coaches and Team members.

 

 

RESOLUTION NO. 1112

 

    BE IT RESOLVED by the City Council of the City of Thibodaux in regular session assembled, that:

 

    WHEREAS, the E.D. White Catholic High School Varsity Volleyball Team advanced to the 2005 LHSAA Division III Playoffs; and

           

    WHEREAS, the said team progressed through the playoffs and attained the title of Division III State Runner-Ups; and

 

    WHEREAS, it has taken a tremendous amount of diligent work, dedication and support from the entire team, coaching staff, students, and parents to accomplish such a feat; and

 

    WHEREAS, all those associated with the aforesaid team have brought a sense of pride and camaraderie to our community and its citizens.

 

    NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Thibodaux does hereby commend Head Coach Mary Cavell, her assistants and the entire E.D. White Catholic High School Varsity Volleyball Team on its title of LHSAA 2005 Division III State Runner-Ups.

 

     The above resolution having been submitted to a vote, the vote thereon was as follows:

RESOLUTION NO. 1113

 

 

    BE IT RESOLVED by the City Council of the City of Thibodaux in regular session assembled, that:

 

    WHEREAS, the E.D. White Catholic High School Boys and Girls Cross Country Teams participated in the LHSAA Class 3A State Meet; and 

           

    WHEREAS, the boys team finished as State Champion of Class 3A and the girls team finished as State Runner-Up of Class 3A at the said meet; and

 

    WHEREAS, it has taken a tremendous amount of diligent work, dedication and support from the entire team, coaching staff, students, and parents to accomplish such a feat; and

 

    WHEREAS, all those associated with the aforesaid team have brought a sense of pride and camaraderie to our community and its citizens.

            Councilman Swanner introduced an ordinance to amend and re-enact Section 2004.1 of the Thibodaux Zoning Ordinance so as to add Sub-Section (15) (Temporary On-Site Signs).  The public hearing on this ordinance will be held at the May 3, 2005 City Council meeting.

 

            The Public Works Director informed the Council Administrator that the State DOTD has proposed that the City continue to maintain the greenspace along State Highways located in our City under the provisions of an agreement under which the City would be compensated for the services.  The City would be required to clean and mow the greenspaces at least four (4) times per year.

 

            On motion of Councilman Gene Richard, seconded by Councilman Mire, the Council voted to adopt a resolution authorizing the mayor to sign a maintenance agreement with Louisiana DOTD for the maintenance of greenspace on State Highways.  Upon roll call the vote was as follows:

 

            YEAS: Councilmen Swanner, G. Richard, Winston, Mire and D. Richard

RESOLUTION NO. 1114

 

 

                                     A RESOLUTION AUTHORIZING THE MAYOR

                                    TO SIGN A MAINTENANCE AGREEMENT WITH

LOUISIANA DOTD FOR THE MAINTENANCE OF

                                    GREEN SPACE ON STATE HIGHWAYS

                         

 

      BE IT RESOLVED by the City Council of the City of Thibodaux in regular session assembled, that:

 

     WHEREAS, the Mayor has received a proposal from the State DOTD to compensate the City to maintain the green spaces located along the State Highway routes which are located within the corporate limits of the City; and

 

     WHEREAS, the State proposes to reimburse the City in the amount of $12,659.90 during the period of July 1, 2005 to June 30, 2006 for the maintenance of green space along 10.35 miles of State highways located within the City; and

 

     WHEREAS, it is necessary to execute a maintenance agreement with the State DOTD for the reimbursements/compensation mentioned hereinbefore.

 

     NOW, THEREFORE BE IT RESOLVED by the City Council that the Mayor be and is hereby authorized to execute a maintenance agreement with the Louisiana DOTD for the maintenance of green space along State Highways located in the City limits as outlined above.

 

    BE IT FURTHER RESOLVED that a copy of the said agreement is attached hereto as "Exhibit A" and thereby made a part hereof.

            A public hearing was then held on an ordinance to amend Section 13-5.5 of the Thibodaux City Code of Ordinances, which is the punitive section of the Noise Ordinance.  The proposed ordinance establishes fines that increase for repeat violators.

 

            Several North Thibodaux residents spoke in favor of the proposed ordinance, while Gabby Barrilleaux and Grady Verrett, bar owners in Thibodaux, were opposed to the amendment of this section.

 

            Councilman Swanner expressed concern over the proposed amendment, and stated that he would like to table the ordinance in order to review the matter further.

 

            On motion of Councilman Mire, seconded by Councilman Gene Richard, the Council voted to adopt an ordinance to amend and re-enact Section 13-5.5 of the Thibodaux City Code of Ordinances (Penalties – Violation of Nuisance Ordinance).  Upon roll call the vote was as follows:

 

            YEAS: Councilmen G. Richard, Winston, Mire and D. Richard

ORDINANCE NO. 2243

 

 

                                    AN ORDINANCE TO AMEND AND RE-ENACT

                                     SECTION 13-5.5 OF THE THIBODAUX CITY CODE

                                    OF ORDINANCES (PENALTIES - VIOLATION

                                    OF NUISANCE ORDINANCE)

 

 

     BE IT ORDAINED by the City Council of the City of Thibodaux in regular session assembled, that Section 13-5.5 of the Thibodaux City Code of Ordinances are hereby amended and re-enacted so as to read as follows:

 

 

     Sec. 13-5.5. Penalty for Violation

 

 

Any person who violates Sections 13-1 through 13-4 pertaining to noise emanating from within a private structure or commercial establishment shall have committed a misdemeanor and shall be fined one hundred ($100.00) dollars for the first offense and shall be fined $500.00 and/or be imprisoned for a period not to exceed ninety (90) days for the second offense and all subsequent offenses.

 

 Upon three violations of the aforesaid sections from a commercial establishment within a one-year period, a court of competent jurisdiction may grant injunctive relief against a violator by means of suspension of the occupational license issued by the City of Thibodaux for a period not to exceed 30 days.  

 

Any person violating these sections pertaining to noise emanating from within a vehicle shall be fined fifty ($50.00) for the first offense, and shall be fined one hundred ($100.00) dollars for the second and all subsequent

offenses.

                       

     The above ordinance having been submitted to a vote, the vote thereon was as follows:

            A public hearing was scheduled on an ordinance to amend Article V of the Zoning Ordinance to create the Zoning Designation of “TND District” and to designate the district regulations thereof. 

 

            On motion of Councilman Mire, seconded by Councilman Gene Richard, the Council voted to table the vote on the ordinance creating the TND District until May 10, 2005 at a special meeting of the Council.  Upon roll call the vote was as follows:

 

            YEAS: Councilmen Swanner, G. Richard, Winston, Mire and D. Richard

            NAYS: None

            ABSENT: None

 

            A public hearing was then scheduled on an ordinance to extend the corporate limits of the City of Thibodaux to include a certain portion of land adjacent thereto that is located in Acadia Plantation.

 

            On motion of Councilman Mire, seconded by Councilman Swanner, the Council voted to table the vote on the ordinance to annex a portion of Acadia Plantation until May 10, 2005 at a special meeting of the Council.  Upon roll call the vote was as follows:
