            The City Council of the City of Thibodaux assembled in regular session at its regular meeting place, City Hall, 310 West 2nd Street, Thibodaux, Louisiana, on Monday, April 5, 2004 at 10:00 o’clock A.M.

            There were present:  Councilmen Gene Richard, Winston, Dee Richard and Mire.

             Councilman Swanner was absent.

            There were also present:  Mayor Charles Caillouet and Ms. Germaine Jackson, City Attorney.

            The minutes of the March 16, 2004 Council meeting were approved as written.

            Councilman Mire recognized the participants of the Mayor for a Day program that were present at the Council meeting.

             The Project Engineer has advised the Council Administrator that the North Canal Boulevard Signalization Project is substantially complete in accordance with all contract documents and specifications.

             On motion of Councilman Dee Richard, seconded by Councilman Winston, the Council voted to adopt a resolution of substantial completion for the North Canal Boulevard Signalization Project that will commence the 45-day lien period on this contract.  Upon roll call the vote was as follows:

            YEAS: Councilmen G. Richard, Winston, D. Richard and Mire

RESOLUTION NO.  1018

     BE IT RESOLVED by the City Council of the City of Thibodaux in regular session assembled, that:

     WHEREAS, the City of Thibodaux entered into a contract with Barriere Construction dated March 18, 2003 for the North Canal Boulevard Signalization Project; and

    WHEREAS, the work under the aforementioned contract was substantially complete in accordance with the plans and specifications by the contractor on February 27, 2004; and

     WHEREAS, a final inspection was conducted by representatives of the City and the Project Engineer; and

      WHEREAS, all work was found to be satisfactory for acceptance with respect to the application for payment by the contractor.

      NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Thibodaux in regular session on April 5, 2004 that the work under the aforementioned project be and is hereby accepted as substantially complete on the date hereinbefore specified.

      BE IT FURTHER RESOLVED that the Council Administrator is hereby authorized to file with the Clerk of Court of the Parish of Lafourche, a certified copy of this resolution in order to commence the 45-day lien period.

      BE IT FURTHER RESOLVED that certified copies of this resolution be forwarded to Barriere Construction Co., P.O. Box 2430, New Orleans, LA  70176, and to Duplantis Design Group, 314 E. Bayou Road, Thibodaux, LA 70301.

The above resolution having been submitted to a vote, the vote thereon was as follows:

              The Council Administrator has met with Councilman Mire concerning the possible amendment to the City’s Subdivision Regulations relative to lot sizes.  There may be a conflict between the lot size requirements in the subdivision regulations and the Zoning Ordinance.  Therefore, the Council Administrator has sent a request to the Zoning Administrator asking that the Planning and Zoning Commission discuss the proposed amendment at their next meeting.

             On motion of Councilman Gene Richard, seconded by Councilman Dee Richard, the Council adopted a motion supporting the review of the regulations and they will act upon any recommendation forwarded by the Planning and Zoning Commission.  Upon roll call the vote was as follows:

             The Administration has informed the Council Administrator that the City is preparing to relocate two sewer lines in the City due to the fact that the existing lines are located on private property.  In order to relocate these lines, the City must acquire servitudes for the construction and maintenance of the new lines.  Several different individuals own the property in which the proposed servitudes will be located.

             Public hearings were held on several ordinances authorizing the Mayor to execute servitude agreements with the property owners in order to relocate the existing sewer lines.

On motion of Councilman Dee Richard, seconded by Councilman Gene Richard, the Council voted to adopt an ordinance authorizing the Mayor to execute a servitude agreement with Kathryn Benoit and Troy Benoit for the relocation of an existing sewer line.  Upon roll call the vote was as follows:

ORDINANCE NO.  2189

  AN ORDINANCE AUTHORIZING THE MAYOR TO EXECUTE A SERVITUDE AGREEMENT WITH KATHRYN AND TROY BENOIT FOR THE RELOCATION OF AN EXISITNG SEWER LINE

             BE IT ORDAINED by the City Council of the City of Thibodaux in regular session assembled, that:

            WHEREAS, the City is in the process of relocating a sewer line in West Thibodaux near Rubaiyat Drive; and

                                    WHEREAS, it is necessary to acquire a fifteen (15’) foot servitude from certain property owners in the area so as to perform the said relocation; and

                                    WHEREAS, it is necessary to authorize the execution of the servitude agreement by the adoption of an appropriate ordinance.

 

                                    NOW, THEREFORE BE IT ORDAINED by the City Council of the City of Thibodaux that the City does hereby authorize the Mayor to execute a servitude agreement with Kathryn and Troy Benoit for the relocation of a sewer line as outlined hereinabove.

 

            BE IT FURTHER ORDAINED that a copy of the servitude agreement is attached hereto as Exhibit "A" and thereby made a part hereof.

            The above ordinance having been submitted to a vote, the vote thereon was as follows:

  ORDINANCE NO. 2192

  AN ORDINANCE AUTHORIZING THE MAYOR TO EXECUTE A SERVITUDE AGREEMENT WITH CARL HECK, JR. AND AMELIA HECK FOR THE RELOCATION OF AN EXISITNG SEWER LINE

             BE IT ORDAINED by the City Council of the City of Thibodaux in regular session assembled, that:

            WHEREAS, the City is in the process of relocating a sewer line in East Thibodaux off Bayou Lane near Belle Meade Subdivision; and

                                    WHEREAS, it is necessary to acquire a ten (10’) foot servitude from certain property owners in the area so as to perform the said relocation; and

                                    WHEREAS, it is necessary to authorize the execution of the servitude agreement by the adoption of an appropriate ordinance.

            NOW, THEREFORE BE IT ORDAINED by the City Council of the City of Thibodaux that the City does hereby authorize the Mayor to execute a servitude agreement with Carl Heck, Jr. and Amelia Heck for the relocation of a sewer line as outlined hereinabove.

             BE IT FURTHER ORDAINED that a copy of the servitude agreement is attached hereto as Exhibit "A" and thereby made a part hereof.

              The Administration has informed the Council Administrator that in conjunction with the FEMA Bayou Lafourche Outfall Project, the City will relocate three flood control gates in the City along Bayou Lafourche that will be located on private property.  In order to construct these flood gates, the City must acquire servitudes for the construction and maintenance of the gates.

             Public hearings were then held on three ordinances authorizing the Mayor to execute servitude agreements with the property owners for the construction and maintenance of outfall control gates.

            On motion of Councilman Winston, seconded by Councilman Dee Richard, the Council voted to adopt an ordinance authorizing the Mayor to execute a servitude agreement with Brian Caldwell, et al for the construction and maintenance of outfall control gates.  Upon roll call the vote was as follows:

             YEAS: Councilmen G. Richard, Winston, D. Richard and Mire

  ORDINANCE NO. 2193

 AN ORDINANCE AUTHORIZING THE MAYOR TO EXECUTE A SERVITUDE AGREEMENT WITH BRIAN CALDWELL, ET AL FOR THE CONSTRUCTION AND MAINTENANCE OF OUTFALL CONTROL GATES

            BE IT ORDAINED by the City Council of the City of Thibodaux in regular session assembled, that:

            WHEREAS, the City is in the process of constructing flood outfall gates at certain points on the batture of Bayou Lafourche; and

                                    WHEREAS, it is necessary to acquire a permanent and construction servitude from the property owners to accommodate the construction of the said flood gates; and

                                    WHEREAS, it is necessary to authorize the execution of the servitude agreement by the adoption of an appropriate ordinance.

            NOW, THEREFORE BE IT ORDAINED by the City Council of the City of Thibodaux that the City does hereby authorize the Mayor to execute a servitude agreement with Brian Caldwell and others for the construction and maintenance of flood control gates on Bayou Lafourche near Coulon Plantation as outlined hereinabove.

              BE IT ORDAINED by the City Council of the City of Thibodaux in regular session assembled, that:

             WHEREAS, the City is in the process of constructing flood outfall gates at certain points on the batture of Bayou Lafourche; and

                                        WHEREAS, it is necessary to acquire a permanent and construction servitude from the property owners to accommodate the construction of the said flood gates; and

                                    WHEREAS, it is necessary to authorize the execution of the servitude agreement by the adoption of an appropriate ordinance.

             A public hearing was then held on an ordinance approving the acceptance of the final plat for the Mount Carmel Subdivision located off of Menard Street.

             On motion of Councilman Dee Richard, seconded by Councilman Winston, the Council voted to adopt an ordinance approving the acceptance of the final plat of the Mount Carmel Subdivision.  Upon roll call the vote was as follows:

ORDINANCE NO. 2196

  AN ORDINANCE APPROVING THE FINAL PLAT OF

THE MOUNT CARMEL SUBDIVISION 

              BE IT ORDAINED by the City Council of the City of Thibodaux in regular session assembled, that:

             WHEREAS, the Planning and Zoning Commission of the City of Thibodaux has reviewed a request by Leonard Chauvin, P.E. concerning the approval of the final plat of the Mount Carmel Subdivision; and

             WHEREAS, the said commission has approved the aforesaid request and is recommending that the City Council concur with their recommendation; and

            WHEREAS, in accordance with the provisions of Section 18-53 of the Thibodaux Subdivision Regulations, the final plat of this subdivision should be accepted by the adoption of an appropriate ordinance.

             NOW, THEREFORE BE IT ORDAINED by the City Council of the City of Thibodaux in regular session assembled, that the final plat of the Mount Carmel Subdivision as recommended by the Planning and Zoning Commission is hereby accepted and approved as requested.

             The Administration has informed the Council Administrator that the City is preparing to relocate two sewer lines in the City due to the fact that the existing lines are located on private property.  In order to relocate these lines, the City must acquire servitudes for the construction and maintenance of the new lines.  Several different individuals own the property in which the proposed servitudes will be located.

             Public hearings were held on several ordinances authorizing the Mayor to execute servitude agreements with the property owners in order to relocate the existing sewer lines.

On motion of Councilman Dee Richard, seconded by Councilman Gene Richard, the Council voted to adopt an ordinance authorizing the Mayor to execute a servitude agreement with Kathryn Benoit and Troy Benoit for the relocation of an existing sewer line.  Upon roll call the vote was as follows:

  AN ORDINANCE AUTHORIZING THE MAYOR TO EXECUTE A SERVITUDE AGREEMENT WITH KATHRYN AND TROY BENOIT FOR THE RELOCATION OF AN EXISITNG SEWER LINE

             BE IT ORDAINED by the City Council of the City of Thibodaux in regular session assembled, that:

            WHEREAS, the City is in the process of relocating a sewer line in West Thibodaux near Rubaiyat Drive; and

                                    WHEREAS, it is necessary to acquire a fifteen (15’) foot servitude from certain property owners in the area so as to perform the said relocation; and

                                    WHEREAS, it is necessary to authorize the execution of the servitude agreement by the adoption of an appropriate ordinance.

 

                                    NOW, THEREFORE BE IT ORDAINED by the City Council of the City of Thibodaux that the City does hereby authorize the Mayor to execute a servitude agreement with Kathryn and Troy Benoit for the relocation of a sewer line as outlined hereinabove.

 

            BE IT FURTHER ORDAINED that a copy of the servitude agreement is attached hereto as Exhibit "A" and thereby made a part hereof.

                                    WHEREAS, it is necessary to acquire a ten (10’) foot servitude from certain property owners in the area so as to perform the said relocation; and

                                    WHEREAS, it is necessary to authorize the execution of the servitude agreement by the adoption of an appropriate ordinance.

            NOW, THEREFORE BE IT ORDAINED by the City Council of the City of Thibodaux that the City does hereby authorize the Mayor to execute a servitude agreement with Carl Heck, Jr. and Amelia Heck for the relocation of a sewer line as outlined hereinabove.

              The Administration has informed the Council Administrator that in conjunction with the FEMA Bayou Lafourche Outfall Project, the City will relocate three flood control gates in the City along Bayou Lafourche that will be located on private property.  In order to construct these flood gates, the City must acquire servitudes for the construction and maintenance of the gates.

             Public hearings were then held on three ordinances authorizing the Mayor to execute servitude agreements with the property owners for the construction and maintenance of outfall control gates.

                                    WHEREAS, it is necessary to acquire a permanent and construction servitude from the property owners to accommodate the construction of the said flood gates; and

                                    WHEREAS, it is necessary to authorize the execution of the servitude agreement by the adoption of an appropriate ordinance.

            NOW, THEREFORE BE IT ORDAINED by the City Council of the City of Thibodaux that the City does hereby authorize the Mayor to execute a servitude agreement with Brian Caldwell and others for the construction and maintenance of flood control gates on Bayou Lafourche near Coulon Plantation as outlined hereinabove.

ORDINANCE NO. 2196

  AN ORDINANCE APPROVING THE FINAL PLAT OF

THE MOUNT CARMEL SUBDIVISION 

              BE IT ORDAINED by the City Council of the City of Thibodaux in regular session assembled, that:

             WHEREAS, the Planning and Zoning Commission of the City of Thibodaux has reviewed a request by Leonard Chauvin, P.E. concerning the approval of the final plat of the Mount Carmel Subdivision; and

             WHEREAS, the said commission has approved the aforesaid request and is recommending that the City Council concur with their recommendation; and

            WHEREAS, in accordance with the provisions of Section 18-53 of the Thibodaux Subdivision Regulations, the final plat of this subdivision should be accepted by the adoption of an appropriate ordinance.

             NOW, THEREFORE BE IT ORDAINED by the City Council of the City of Thibodaux in regular session assembled, that the final plat of the Mount Carmel Subdivision as recommended by the Planning and Zoning Commission is hereby accepted and approved as requested.
