            MAY 17, 2005
     

            

The City Council of the City of Thibodaux assembled in regular session at its regular meeting place, City Hall, 310 West 2nd Street, Thibodaux, Louisiana, on Tuesday, May 17, 2005 at 5:00 o’clock P.M.

 

            There were present:  Councilmen Swanner, G. Richard, Winston, Mire and Dee Richard.

 

            There were also present:  Mayor Charles Caillouet and Germaine Jackson.

 

            The minutes of the May 3, 2005 and May 10, 2005 Council meetings were approved as written.

           

            Ed Bouterie of Bourgeois Bennett presented the 2004 Audit Report relative to the City’s financial status for the period ending December 31, 2004.  The Auditors expressed that the audit was a clean audit with no incident of any irregularities.

 

            Councilman Gene Richard introduced an ordinance assessing the ad-valorem taxes for the City for the year 2005.  The public hearing on this ordinance will be held at the June 7, 2005 City Council meeting.

 

            Councilman Mire introduced an ordinance authorizing the Mayor to execute a lease agreement with Bayouland Properties for the lease of office space for the City’s Federal Programs Office.  The public hearing on this ordinance will be held at the June 7, 2005 City Council meeting.

 

            A public hearing was then held on an ordinance authorizing the execution of a Cooperative Endeavor Agreement with the Lafourche Parish Sheriff’s Office.

 

            The Administration informed the Council Administrator that the City has an obligation to provide protection and investigative services for children who are victims of abuse or neglect.  In order to eliminate the duplication of services within law enforcement agencies of the Parish, the Lafourche Parish Sheriff’s Office has agreed to provide these services for the entire parish by operating a Children’s Advocacy Center.

 

            The City intends to participate and utilize the services provided by the center.  Therefore, the City will provide funding in an amount not to exceed $10,000 for this year, which is payable on or before December 31, 2005.

 

            On motion of Councilman Mire, seconded by Councilman Gene Richard, the Council voted to adopt an ordinance authorizing the Mayor to execute a Cooperative Endeavor Agreement with the Lafourche Parish Sheriff’s Office.  Upon roll call the vote was as follows:

 

            YEAS: Councilmen Swanner, G. Richard, Winston, Mire and D. Richard

            NAYS: None

            ABSENT: None

 

ORDINANCE NO. 2248

 

AN ORDINANCE AUTHORIZING THE MAYOR TO EXECUTE A COOPERATIVE ENDEAVOR AGREEMENT WITH THE LAFOURCHE PARISH SHERIFF’S OFFICE

 

            BE IT ORDAINED by the City Council of the City of Thibodaux in regular session assembled, that:

 

            WHEREAS, the City has an obligation to provide protection and investigative services for the child victim of abuse or neglect; and

 

            WHEREAS, in order to lessen the duplication of services the Lafourche Parish Sheriff’s Office will provide funding to hire the personnel necessary to operate an Children’s Advocacy Center to be utilized by the Thibodaux Police Department; and

 

            WHEREAS, the City will provide funding an amount not to exceed $10,000 payable on or before December 31, 2005 to offset the costs incurred by the Sheriff’s Office; and

 

            WHEREAS, in order for the City to provide the said funding, it is necessary to execute a cooperative endeavor agreement outlining the benefits to be received by the City of Thibodaux in exchange for the said funding; and

 

            WHEREAS, in order for the City to execute this proposed agreement it is necessary for the Council to authorize the Mayor to execute the said cooperative endeavor agreement.

 

            NOW, THEREFORE BE IT ORDAINED by the City Council that the Mayor is hereby authorized to execute a Cooperative Endeavor Agreement with the Lafourche Parish Sheriff’s Office for the purposes, and under the conditions mentioned hereinabove.

 

            BE IT FURTHER ORDAINED that a copy of the said agreement is attached hereto as Exhibit “A” and thereby made a part hereof.

 

            The above ordinance having been submitted to a vote, the vote thereon was as follows:

 

            YEAS: Councilmen Swanner, G. Richard, Winston, Mire and D. Richard

            NAYS: None

            ABSTAINED: None

            ABSENT: None

 

            And the above ordinance was declared adopted this 17th day of May 2005.

            A public hearing was then held on an ordinance authorizing a contract with INCODE for property tax management software module.  The cost of the software and annual maintenance services for the software will be provided at a total cost of $28,267.

 

            On motion of Councilman Mire, seconded by Councilman Gene Richard, the Council voted to adopt an ordinance authorizing the Mayor to sign a contract with INCODE, Inc for Property Tax Management Software Module.  Upon roll call the vote was as follows:

 

            YEAS: Councilmen Swanner, G. Richard, Winston, Mire and D. Richard

            NAYS: None

            ABSENT: None

 

ORDINANCE NO. 2249

 

AN ORDINANCE AUTHORIZING THE MAYOR TO SIGN A CONTRACT WITH INCODE, INC FOR PROPERTY TAX MANAGEMENT SOFTWARE MODULE

 

 

BE IT ORDAINED by the City Council of the City of Thibodaux in regular session assembled, that:

 

WHEREAS, the City has negotiated for the acquisition of Property Tax Software, Maintenance and Support for the City; and

 

WHEREAS, after careful evaluation relative to cost, experience and support the proposal received from INCODE, Inc. was selected by the Administration as the proposal which best fits the needs of the City; and

 

WHEREAS, it is necessary to execute a contract with the said firm for the services mentioned hereinbefore,

 

NOW, THEREFORE BE IT ORDAINED by the City Council that the Mayor be and is hereby authorized to execute a contract with INCODE, Inc. for the services as mentioned above.

 

BE IT FURTHER ORDAINED that a copy of the said contract is attached hereto as "Exhibit A" and thereby made a part hereof.

 

The above ordinance having been submitted to a vote, the vote thereon was as follows:

 

YEAS: Councilmen Swanner, G. Richard, Winston, Mire and D. Richard

            NAYS: None

            ABSTAINED: None

            Mr. Curtis Hue thanked Councilman Gene Richard for his work and dedication to keeping the citizens informed through his talk show on KTIB.

 

            On motion of Councilman Mire, seconded by Councilman Swanner, the Council voted to add comments by Mr. Lea Rutter to the Council’s meeting agenda.  Upon roll call the vote was as follows:

 

            YEAS: Councilmen Swanner, G. Richard, Winston, Mire and D. Richard

            NAYS: None

            ABSENT: None

 

            Mr. Rutter addressed the Council and Mayor with questions and concerns about the Cooperative Endeavor Agreement with Acadia Agricultural Holdings that was authorized at the May 10, 2005 Special City Council meeting.  Mr. Rutter felt that the City could have provided more public notification prior to the special meeting.

 

            Mr. Rutter stated that he did not attend the special meeting because he did not know that it was being held, and he asked that the Council and Administration answer some questions regarding the cooperative endeavor agreement and the annexation of a portion of property owned by Acadia.

 

            There being no further business the meeting was adjourned.
