            The City Council of the City of Thibodaux assembled in regular session at its regular meeting place, City Hall, 310 West 2nd Street, Thibodaux, Louisiana, on Tuesday, January 18, 2005 at 5:00 o’clock P.M.

 

            There were present:  Councilmen Gene Richard, Winston, Mire and Dee Richard.

 

            Councilman Swanner was absent.

 

            There were also present:  Mayor Charles Caillouet and Germaine Jackson.

 

            The minutes of the January 4, 2005 Council meeting were approved as written.

           

            Mr. John Roques of 132 Goode Street and Mr. Richard Naquin of 126 Goode Street addresses the Council concerning drainage problems in the rear yards of the 100 block of Goode Street that have arisen since the construction of the Mount Carmel Subdivision.  They requested that the Council and the Administration look into these problems and work with them to come up with a resolution to this problem.

 

            The Project Engineer has advised the Council Administrator that it is necessary for the City Council to consider approving Change Order no. 1 for the North Sector Water Line Project.  This change order is being proposed in order to adjust the contract price as a result of approved additional work and the final adjustment and reconciliation of all contract quantities.  The change order will increase the contract price by $8,358.23.

 

            On motion of Councilman Mire, seconded by Councilman Gene Richard, the Council voted to adopt a resolution approving Change Order No. 1 for the North Sector Water Line Project.  Upon roll call the vote was as follows:

 

            YEAS: Councilmen G. Richard, Winston, Mire and D. Richard

RESOLUTION NO.  1094

 

 

A RESOLUTION AUTHORIZING THE MAYOR TO SIGN CHANGE ORDER #1 WITH BEVERLY CONSTRUCTION COMPANY, LLC FOR THE NORTH SECTOR WATER 

                        DISTRIBUTION LINE PROJECT

 

     BE IT RESOLVED by the City Council of the City of Thibodaux in regular session assembled, that:

 

     WHEREAS, the City entered into a contract with Beverly Construction, LLC, for the construction of the North Sector Water Distribution Line; and

 

     WHEREAS, due to the reconciliation of all contract quantities and any additional work authorized, the execution of a change order is required; and

 

     WHEREAS, the proposed change order increases the contract price in the amount of  $8,358.23 over the original contract bid for a final contract price of $703,477.23.

 

     NOW, THEREFORE BE IT RESOLVED by the City Council that the Mayor be and is hereby authorized to execute Change Order No. 1 with Beverly Construction, LLC, in the amount mentioned above.

 

     BE IT FURTHER RESOLVED that a copy of the said change order is attached hereto as "Exhibit A" and thereby made a part hereof.

            A renewal application for participation on the Restoration Tax Abatement Program has been filed with the State for improvements to the structure located at 102 West 4th Street (Kem Supply).  The project, which has been designated as Application No. 1997-0491-4319 does meet the criteria for participation.

 

            On motion of Councilman Gene Richard, seconded by Councilman Mire, the Council voted to adopt a resolution approving the restoration tax abatement renewal application submitted for 102 West 4th Street (Kem Supply).  Upon roll call the vote was as follows:

RESOLUTION NO.  1095

 

 

BE IT RESOLVED by the City Council of the City of Thibodaux in regular session assembled, that:

 

WHEREAS, the Restoration Tax Abatement Program has been created by the Electors of the State of Louisiana as Act 445 of 1983, and amended in Act 873 of 1984, Article VII, Part II, Section 21 (H) of the Louisianan Constitution and Louisiana R.S. 47: 4311-4319, to authorize the Board of Commerce and Industry, with the approval of the Governor and the local governing authority and in accordance with procedures and conditions provided by law, to enter into a contract granting property owners who propose the expansion, restoration, improvement or development of an existing structure or structures in a downtown development district, historic district, or economic development district, established in accordance with law, the right to pay ad valorem taxes based upon the assessed valuation of property prior to the commencement of the expansion, restoration, improvement or development, and

 

WHEREAS, the City of Thibodaux desires to promote economic activity, create and retain job opportunities, and improve the tax base through the City for the benefit of all citizens, and

 

WHEREAS, it is the desire of the City Council to foster the continued growth and development (and redevelopment) of the City to the continued prosperity and welfare of the City, and

 

WHEREAS, the Thibodaux City Council at it's January 18, 2005 meeting recommended approval with regard to participation in the aforementioned tax program.

 

NOW, THEREFORE BE IT RESOLVED by the City of Thibodaux in due, regular and legal session convened that the City Council hereby approves Restoration Abatement Program Application/Renewal Application Number 1997-0491-68 for participation in the Restoration Tax Abatement Program.

 

BE IT FURTHUR RESOLVED that if any provision or item of this resolution or the application/renewal application thereof is held invalid, such invalidity shall not affect other provisions, items or applications of this resolution which ban be given effect without invalid provisions, items of application and to this end the provisions of this resolution are hereby declared severable.

            The Civil Service Director has advised the Council Administrator that the term of Mrs. Lorraine Watkins on the Thibodaux Civil Service Board has expired.  Under the provisions of Article IV, Section 6 of the City Charter, for all vacancies on the said board, the Council shall solicit a nomination from the nominating agency for the board member whose term has expired. 

 

            Dr. Edward Jackson, Chancellor of Southern University has submitted a letter nominating Mrs. Watkins to the Thibodaux Civil Service Board.

 

            On motion of Councilman Mire, seconded by Councilman Gene Richard, the Council voted to adopt a resolution approving the re-appointment of Mrs. Lorraine Watkins as a member of the Thibodaux Civil Service Board.  Upon roll call the vote was as follows:

RESOLUTION NO. 1096

 

 

            BE IT RESOLVED by the City Council of the City of Thibodaux in regular session assembled, that:

 

            WHEREAS, the Thibodaux Municipal Civil Service Board is comprised of five regular members; and

 

            WHEREAS, due to the fact that one of the current members’ term has expired on the above said board, the appointing agency has forwarded a nomination to the City Council to re-appoint that member; and

 

            WHEREAS, in accordance with the method of nomination employed in the City Charter, Southern University has nominated Mrs. Lorraine Watkins to be re-appointed to her position on the Thibodaux Civil Service Board.

 

            NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Thibodaux that in accordance with the provisions of Article IV, Section 6 of the Thibodaux City Charter, the re-appointment of Mrs. Lorraine Watkins to the Thibodaux Civil Service Board is hereby ratified effective January 18, 2005.

 

            BE IT FURTHER RESOLVED that the term of Mrs. Watkins will expire January 18, 2009.

            At their January 11, 2005 meeting, the Thibodaux Civil Service Board voted to approve the re-grading of the position of Housing Quality Standards Inspector from Grade 56 to Grade 58 of System B of the salary structure.

 

            On motion of Councilman Mire, seconded by Councilman Gene Richard, the Council voted to adopt a resolution approving the recommendation of the Civil Service Board changing the salary grade for the position of Housing Quality Standards Inspector.  Upon roll call the vote was as follows:

RESOLUTION NO.  1097

 

 

     BE IT RESOLVED by the City Council of the City of Thibodaux in regular session assembled, that:

 

     WHEREAS, the City Council has reviewed a request by the Civil Service Board and the Director of Federal Programs to re-grade the position of Housing Quality Standards Inspector; and

 

     WHEREAS, the said board has recommended that the job description be re-graded and placed in Grade 58 of System B of the pay plan; and

 

     WHEREAS, the said board has approved the request made and has recommended that the City Council approve these changes to the pay plan.   

     

    NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Thibodaux does hereby approve the amendment of the Civil Service Pay Plan by re-grading the position of Housing Quality Standards Inspector into Grade 58 of System B of the pay plan as per the recommendation of the Thibodaux Civil Service Board.

            The City executed a contract with Leonard Chauvin for engineering services for improvements to the runway at the Thibodaux Municipal Airport.  The compensation paid to the engineer was to be in accordance with the percentage scale provided in the contract.

 

            The Grants Director informed the Council Administrator that the Mayor has applied for reimbursements in conjunction with the FAA Grant that funded the improvements to the airport runway.  The FAA has informed the City that the compensation provided for in the engineering contract should have been a lump sum payment rather than payment based on the scale.

 

            It is necessary for the City to amend the provisions of the contract so as to provide compensation to the engineer in a lump sum method.  This proposed change in method of compensation will not increase the payments made to the engineer.

 

            On motion of Councilman Mire, seconded by Councilman Gene Richard, the Council voted to adopt a resolution amending the Engineering Contract with Leonard Chauvin for the Airport Runway Improvement Project.  Upon roll call the vote was as follows:

RESOLUTION NO. 1098

 

 

A RESOLUTION AUTHORIZING THE MAYOR TO AMEND THE ENGINEERING CONTRACT WITH LEONARD CHAUVIN AS PER COMPLIANCE WITH FAA REGULATIONS AND FOR REIMBURSEMENT FOR IMPROVEMENTS AT THE THIBODAUX MUNICPAL AIRPORT

 

 

            BE IT RESOLVED By the City Council of the City of Thibodaux in regular session assembled, that:

 

            WHEREAS, the City received a federal grant from the Federal Aviation Administration to construct improvements to the runway and apron at the Thibodaux Municipal Airport; and

 

            WHEREAS, the City is required by the FAA to amend the Professional Engineering Services Agreement with Leonard Chauvin P. E., P.L.S, Inc. so as to change the method of compensation from a percentage of construction to a lump sum contract; and

 

            WHEREAS, this amendment is necessary for the City to receive reimbursement from the Federal Aviation Administration (FAA) for the improvements to the runway where to Advisory Circular 150/5100-14; and

 

            WHEREAS, said amendment to the contract would provide for a lump sum fee for services not to exceed the amount approved for engineering fees for the project.

 

            BE IT FURTHER RESOLVED that a copy of said amendment is attached hereto as “Exhibit A” and thereby made a part hereof.

             A public hearing was then held on an ordinance to extend the corporate limits of the City of Thibodaux to include a certain portion of land adjacent thereto.

 

            The City has been approached by Nicholls State University and the J.B. Levert Land Company concerning the annexation of property into the corporate limits of the City Of Thibodaux.  The said entities have formalized their request by submitting petitions to the City for the said annexation.  In addition, the Lafourche Parish School Board has joined with the other annexation requests due to the fact that they own a small tract of property next to Nicholls State University and wished to state their approval of the proposed annexation by also submitting a petition.

 

            The properties requested for annexation are the property on which the Rienzi Plantation Home is located, along with property adjacent to the home located at the intersection of Rosedown Drive and LA Highway 308.  The other tract is that tract of property currently owned by Nicholls State (State of Louisiana) that is located between the current corporate limits and the westernmost boundary of the right-of-way of Bowie Road.  This proposed annexation would insure that all current Nicholls State property is located within the corporate limits of the City.

 

            On motion of Councilman Gene Richard, seconded by Councilman Mire, the Council voted to adopt an ordinance to extend the corporate limits of the City of Thibodaux to include a certain portion of land adjacent thereto.  Upon roll call the vote was as follows:

ORDINANCE NO.  2234

 

 

                   AN ORDINANCE TO EXTEND THE CORPORATE LIMITS

                   OF THE CITY OF THIBODAUX TO INCLUDE A CERTAIN

                   PORTION OF LAND ADJACENT THERETO

 

 

     BE IT ORDAINED by the City Council of the City of Thibodaux in regular session assembled, that:

 

     WHEREAS, the City of Thibodaux, Louisiana has received a petition from the owners of certain tracts of land adjacent to the corporate limits of the City of Thibodaux, Parish of Lafourche, State of Louisiana, which said petition requests that certain lands be incorporated within the City limits of the City of Thibodaux; and

 

     WHEREAS, notice by publication in the official journal of the City of Thibodaux has been given of the City's intention to extend its limits; and

 

     WHEREAS, more than ten days have elapsed since the date of the publication of the said notice.

 

     NOW, THEREFORE BE IT ORDAINED by the City Council of the City of Thibodaux in regular session assembled, that the corporate limits of the City of Thibodaux be extended to include the following properties:

     BE IT FURTHER ORDAINED that the properties annexed will be accepted into the corporate limits of the City with the zoning designation of R-4 until amended following a recommendation of the Planning and Zoning Commission.

 

     BE IT FURTHER ORDAINED that all undeveloped real estate included in this annexation shall be exempt from the assessment of municipal ad valorem taxes until such time as the property is transferred or developed.

 

     BE IT FURTHER ORDAINED that the above said described Tracts 1 and 2 of the annexed property is hereby designated to be included in Council District A and the property described in Tract 3 designated to be included in Council District B until changed by a future reapportionment of Council districts as required by the U.S. Justice Department.

 

     BE IT FURTHER ORDAINED that the entire boundary of the City Of Thibodaux as herein changed shall henceforth be as follows:

            The City Council of the City of Thibodaux assembled in regular session at its regular meeting place, City Hall, 310 West 2nd Street, Thibodaux, Louisiana, on Tuesday, January 18, 2005 at 5:00 o’clock P.M.

 

            There were present:  Councilmen Gene Richard, Winston, Mire and Dee Richard.

 

            Councilman Swanner was absent.

 

            There were also present:  Mayor Charles Caillouet and Germaine Jackson.

 

            The minutes of the January 4, 2005 Council meeting were approved as written.

           

            Mr. John Roques of 132 Goode Street and Mr. Richard Naquin of 126 Goode Street addresses the Council concerning drainage problems in the rear yards of the 100 block of Goode Street that have arisen since the construction of the Mount Carmel Subdivision.  They requested that the Council and the Administration look into these problems and work with them to come up with a resolution to this problem.

 

            The Project Engineer has advised the Council Administrator that it is necessary for the City Council to consider approving Change Order no. 1 for the North Sector Water Line Project.  This change order is being proposed in order to adjust the contract price as a result of approved additional work and the final adjustment and reconciliation of all contract quantities.  The change order will increase the contract price by $8,358.23.

 

            On motion of Councilman Mire, seconded by Councilman Gene Richard, the Council voted to adopt a resolution approving Change Order No. 1 for the North Sector Water Line Project.  Upon roll call the vote was as follows:

RESOLUTION NO.  1094

 

 

A RESOLUTION AUTHORIZING THE MAYOR TO SIGN CHANGE ORDER #1 WITH BEVERLY CONSTRUCTION COMPANY, LLC FOR THE NORTH SECTOR WATER 

                        DISTRIBUTION LINE PROJECT

 

     BE IT RESOLVED by the City Council of the City of Thibodaux in regular session assembled, that:

 

     WHEREAS, the City entered into a contract with Beverly Construction, LLC, for the construction of the North Sector Water Distribution Line; and

 

     WHEREAS, due to the reconciliation of all contract quantities and any additional work authorized, the execution of a change order is required; and

 

     WHEREAS, the proposed change order increases the contract price in the amount of  $8,358.23 over the original contract bid for a final contract price of $703,477.23.

 

     NOW, THEREFORE BE IT RESOLVED by the City Council that the Mayor be and is hereby authorized to execute Change Order No. 1 with Beverly Construction, LLC, in the amount mentioned above.

 

     BE IT FURTHER RESOLVED that a copy of the said change order is attached hereto as "Exhibit A" and thereby made a part hereof.

BE IT RESOLVED by the City Council of the City of Thibodaux in regular session assembled, that:

 

WHEREAS, the Restoration Tax Abatement Program has been created by the Electors of the State of Louisiana as Act 445 of 1983, and amended in Act 873 of 1984, Article VII, Part II, Section 21 (H) of the Louisianan Constitution and Louisiana R.S. 47: 4311-4319, to authorize the Board of Commerce and Industry, with the approval of the Governor and the local governing authority and in accordance with procedures and conditions provided by law, to enter into a contract granting property owners who propose the expansion, restoration, improvement or development of an existing structure or structures in a downtown development district, historic district, or economic development district, established in accordance with law, the right to pay ad valorem taxes based upon the assessed valuation of property prior to the commencement of the expansion, restoration, improvement or development, and

 

WHEREAS, the City of Thibodaux desires to promote economic activity, create and retain job opportunities, and improve the tax base through the City for the benefit of all citizens, and

 

WHEREAS, it is the desire of the City Council to foster the continued growth and development (and redevelopment) of the City to the continued prosperity and welfare of the City, and

 

WHEREAS, the Thibodaux City Council at it's January 18, 2005 meeting recommended approval with regard to participation in the aforementioned tax program.

 

NOW, THEREFORE BE IT RESOLVED by the City of Thibodaux in due, regular and legal session convened that the City Council hereby approves Restoration Abatement Program Application/Renewal Application Number 1997-0491-68 for participation in the Restoration Tax Abatement Program.

 

BE IT FURTHUR RESOLVED that if any provision or item of this resolution or the application/renewal application thereof is held invalid, such invalidity shall not affect other provisions, items or applications of this resolution which ban be given effect without invalid provisions, items of application and to this end the provisions of this resolution are hereby declared severable.

            WHEREAS, due to the fact that one of the current members’ term has expired on the above said board, the appointing agency has forwarded a nomination to the City Council to re-appoint that member; and

 

            WHEREAS, in accordance with the method of nomination employed in the City Charter, Southern University has nominated Mrs. Lorraine Watkins to be re-appointed to her position on the Thibodaux Civil Service Board.

     WHEREAS, the City Council has reviewed a request by the Civil Service Board and the Director of Federal Programs to re-grade the position of Housing Quality Standards Inspector; and

 

     WHEREAS, the said board has recommended that the job description be re-graded and placed in Grade 58 of System B of the pay plan; and

 

     WHEREAS, the said board has approved the request made and has recommended that the City Council approve these changes to the pay plan.   

     

    NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Thibodaux does hereby approve the amendment of the Civil Service Pay Plan by re-grading the position of Housing Quality Standards Inspector into Grade 58 of System B of the pay plan as per the recommendation of the Thibodaux Civil Service Board.

            The City executed a contract with Leonard Chauvin for engineering services for improvements to the runway at the Thibodaux Municipal Airport.  The compensation paid to the engineer was to be in accordance with the percentage scale provided in the contract.

 

            The Grants Director informed the Council Administrator that the Mayor has applied for reimbursements in conjunction with the FAA Grant that funded the improvements to the airport runway.  The FAA has informed the City that the compensation provided for in the engineering contract should have been a lump sum payment rather than payment based on the scale.

 

            It is necessary for the City to amend the provisions of the contract so as to provide compensation to the engineer in a lump sum method.  This proposed change in method of compensation will not increase the payments made to the engineer.

 

            On motion of Councilman Mire, seconded by Councilman Gene Richard, the Council voted to adopt a resolution amending the Engineering Contract with Leonard Chauvin for the Airport Runway Improvement Project.  Upon roll call the vote was as follows:

A RESOLUTION AUTHORIZING THE MAYOR TO AMEND THE ENGINEERING CONTRACT WITH LEONARD CHAUVIN AS PER COMPLIANCE WITH FAA REGULATIONS AND FOR REIMBURSEMENT FOR IMPROVEMENTS AT THE THIBODAUX MUNICPAL AIRPORT

 

 

            BE IT RESOLVED By the City Council of the City of Thibodaux in regular session assembled, that:

 

            WHEREAS, the City received a federal grant from the Federal Aviation Administration to construct improvements to the runway and apron at the Thibodaux Municipal Airport; and

 

            WHEREAS, the City is required by the FAA to amend the Professional Engineering Services Agreement with Leonard Chauvin P. E., P.L.S, Inc. so as to change the method of compensation from a percentage of construction to a lump sum contract; and

 

            WHEREAS, this amendment is necessary for the City to receive reimbursement from the Federal Aviation Administration (FAA) for the improvements to the runway where to Advisory Circular 150/5100-14; and

 

            WHEREAS, said amendment to the contract would provide for a lump sum fee for services not to exceed the amount approved for engineering fees for the project.

             A public hearing was then held on an ordinance to extend the corporate limits of the City of Thibodaux to include a certain portion of land adjacent thereto.

 

            The City has been approached by Nicholls State University and the J.B. Levert Land Company concerning the annexation of property into the corporate limits of the City Of Thibodaux.  The said entities have formalized their request by submitting petitions to the City for the said annexation.  In addition, the Lafourche Parish School Board has joined with the other annexation requests due to the fact that they own a small tract of property next to Nicholls State University and wished to state their approval of the proposed annexation by also submitting a petition.

 

            The properties requested for annexation are the property on which the Rienzi Plantation Home is located, along with property adjacent to the home located at the intersection of Rosedown Drive and LA Highway 308.  The other tract is that tract of property currently owned by Nicholls State (State of Louisiana) that is located between the current corporate limits and the westernmost boundary of the right-of-way of Bowie Road.  This proposed annexation would insure that all current Nicholls State property is located within the corporate limits of the City.

 

            On motion of Councilman Gene Richard, seconded by Councilman Mire, the Council voted to adopt an ordinance to extend the corporate limits of the City of Thibodaux to include a certain portion of land adjacent thereto.  Upon roll call the vote was as follows:

     WHEREAS, the City of Thibodaux, Louisiana has received a petition from the owners of certain tracts of land adjacent to the corporate limits of the City of Thibodaux, Parish of Lafourche, State of Louisiana, which said petition requests that certain lands be incorporated within the City limits of the City of Thibodaux; and

 

     WHEREAS, notice by publication in the official journal of the City of Thibodaux has been given of the City's intention to extend its limits; and
