The City Council of the City of Thibodaux assembled in regular session at its regular meeting place, City Hall, 310 West 2nd Street, Thibodaux, Louisiana, on Tuesday, December 7, 2004 at 5:00 o’clock P.M.

 

            There were present:  Councilmen Swanner, Winston, Dee Richard and Mire.

           

            Councilman Gene Richard was absent.

 

            There were also present:  Mayor Charles Caillouet and Germaine Jackson.

 

            The minutes of the November 16, 2004 Council meeting and the November 30, 2004 special Council meeting were approved as written.

 

            The Finance Director has informed the Council Administrator that it is time to present the Council with the year-end supplemental appropriation to the 2004 budget.

 

            Councilman Dee Richard introduced an ordinance to amend Ordinance No. 2173 “Appropriation Ordinance for the year 2004” (Supplemental Appropriation).  The public hearing on this ordinance will be held at the December 21, 2004 City Council meeting.

 

            The Project Engineer has advised the Council Administrator that it is necessary for the City Council to consider the approval of Change Order No. 1 for the North Sector Elevated Water Storage Tank Project.  This change order is being proposed in order to adjust the contract price as a result of the removal of underground concrete obstructions at the site location.  This change order will increase the contract price by $19,694.73 thereby making the final contract price $965,694.73. 

            On motion of Councilman Dee Richard, seconded by Councilman Swanner, the Council voted to adopt a resolution approving Change Order No. 1 for the North Thibodaux Water Tower Project.  Upon roll call the vote was as follows: 

            YEAS: Councilmen Swanner, Winston, D. Richard and Mire

            NAYS: None

            ABSENT: Councilman G. Richard

 

RESOLUTION NO. 1089 

 

A RESOLUTION AUTHORIZING THE MAYOR TO SIGN CHANGE ORDER #1 WITH CALDWELL TANKS, INC. FOR THE NORTH SECTOR ELEVATED WATER STORAGE

TANK 

 

     BE IT RESOLVED by the City Council of the City of Thibodaux in regular session assembled, that:

 

     WHEREAS, the City entered into a contract with Caldwell Tanks, Inc. for the construction of the North Sector Elevated Water Storage Tank; and

 

     WHEREAS, due to the reconciliation of all contract quantities which includes the removal of underground concrete obstructions, the execution of a change order is required; and

 

     WHEREAS, the proposed change order increases the contract price in the amount of  $19,694.73 over the original contract bid for a final contract price of $965,694.73

 

     NOW, THEREFORE BE IT RESOLVED by the City Council that the Mayor be and is hereby authorized to execute Change Order No. 1 with Caldwell Tanks, Inc. in the amount mentioned above.

 

     BE IT FURTHER RESOLVED that a copy of the said change order is attached hereto as "Exhibit A" and thereby made a part hereof.

 

     The above resolution having been submitted to a vote, the vote thereon was as follows:

 

     YEAS: Councilmen Swanner, Winston, D. Richard and Mire

     ABSTAINED: None

            The Project Engineer, Mr. Leonard Chauvin, has advised the Council Administrator that the Thibodaux Airport Runway Overlay Project is substantially complete in accordance with all contract documents and specifications.  It is necessary for the Council to consider the adoption of a resolution of substantial completion in order to commence the 45-day lien period on this contract.

 

            On motion of Councilman Winston, seconded by Councilman Dee Richard, the Council voted to adopt a resolution of substantial completion for the airport runway overlay project.  Upon roll call the vote was as follows:

 

            YEAS: Councilmen Swanner, Winston, D. Richard and Mire

            NAYS: None

            ABSENT: Councilman G. Richard

 

RESOLUTION NO. 1090

 

     BE IT RESOLVED by the City Council of the City of Thibodaux in regular session assembled, that:

 

     WHEREAS, the City of Thibodaux entered into a contract with Barriere Construction Co., L.L.C. dated October 19, 2004 for the Thibodaux Airport Runway Overlay Project; and 

   

     WHEREAS, the work under the aforementioned contract was substantially complete in accordance with the plans and specifications by the contractor on November 9, 2004; and

 

     WHEREAS, a final inspection was conducted by representatives of the City and the Project Engineer; and

 

     WHEREAS, all work except any items which may be listed on a punch list, was found to be satisfactory for acceptance with respect to the application for payment by the contractor.

 

     NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Thibodaux in regular session on December 7, 2004 that the work under the aforementioned project be and is hereby accepted as substantially complete on the date hereinbefore specified.

 

     BE IT FURTHER RESOLVED that the Council Administrator is hereby authorized to file with the Clerk of Court of the Parish of Lafourche, a certified copy of this resolution in order to commence the 45-day lien period.

 

     BE IT FURTHER RESOLVED that certified copies of this resolution be forwarded to Barriere Construction Co., L.L.C., P.O. Box 1576, Boutte, LA 70039, and to Leonard Chauvin, P.E., 618A Canal Boulevard, Thibodaux, LA 70301.  

            The above resolution having been submitted to a vote, the vote thereon was as follows: 

     YEAS: Councilmen Swanner, Winston, D. Richard and Mire

            The City Attorney has requested that the City secure the services of a special legal counsel to represent the City in the litigation Ronnie Martine, Sr. et al vs. The City of Thibodaux.  The Mayor wishes to secure the services of Mr. Lloyd Bourgeois to act as special legal counsel in this matter. 

            This litigation involves an issue concerning a student assigned to the PASS program at Thibodaux High School.  The student was assaulted during this time, and allegedly the Thibodaux Police Officer and the High School personnel were not present to prevent the assault. 

            On motion of Councilman Swanner, seconded by Councilman Winston, the Council voted to adopt a resolution authorizing the Mayor to execute a contract with Lloyd Bourgeois to act as special legal counsel for the lawsuit Ronnie Martino, Sr. et al vs. the City of Thibodaux.  Upon roll call the vote was as follows: 

            YEAS: Councilmen Swanner Winston, D. Richard and Mire

            NAYS: None

            ABSENT: Councilman G. Richard 

RESOLUTION NO. 1091 

 

                                     A RESOLUTION AUTHORIZING THE MAYOR

                                     TO SIGN A CONTRACT WITH THE LLOYD

 BOURGEOIS AS SPECIAL LEGAL COUNSEL

 FOR THE CITY                         

 

      BE IT RESOLVED by the City Council of the City of Thibodaux in regular session assembled, that;

 

     WHEREAS, the City is a defendant in the litigation Ronnie Martino, Sr. and Melissa G. Martino vs. the City of Thibodaux and the Lafourche Parish School Board; and

 

     WHEREAS, it is the opinion of the City Attorney that the City should be represented by special legal counsel due to the nature of this matter; and

 

     WHEREAS, in accordance with the provisions of Article V, Section 2 of the City Charter it is necessary for the Mayor to select the special legal counsel to represent the City; and

 

     WHEREAS, the Mayor has selected Mr. Lloyd Bourgeois to represent the City in the aforesaid matter as the said special legal counsel.

 

     NOW, THEREFORE BE IT RESOLVED that the City Council does hereby confirm the selection of Mr. Lloyd Bourgeois as special legal counsel for the City, and does authorize him to execute an agreement with the said individual.

 

     The above resolution having been submitted to a vote, the vote thereon was as follows:

            A public hearing was held on an ordinance authorizing the execution of a sales tax agreement with the Lafourche Parish School Board. 

The Lafourche Parish School Board is the central collection agency for public agencies in the parish of Lafourche for the collection of sales and use taxes.  The City’s current agreement with the school board expired at the end of June and therefore, it is necessary for the City to execute a new agreement for an additional two (2) year period.  The current commission paid to the school board for collection services is 0.85%. 

            After a recent meting with the Lafourche Parish Tax Oversight Committee, the school board has presented the Mayor with a proposed agreement which proposed to collect the sales and use tax for the City and charge all agencies a commission of 0.90% for the collection services rendered. 

            On motion of Councilman Dee Richard, seconded by Councilman Winston, the Council voted to adopt an ordinance authorizing the Mayor to execute a Sales Tax Agreement with the Lafourche Parish School Board for the collection of the City’s sales and use taxes.  Upon roll call the vote was as follows: 

            YEAS: Councilmen Swanner, Winston, D. Richard and Mire

            NAYS: None

            ABSENT: Councilman G. Richard

 

ORDINANCE NO.  2231 

                                    AN ORDINANCE AUTHORIZING THE MAYOR

                                    TO EXECUTE A SALES TAX AGREEMENT WITH

                                    THE LAFOURCHE PARISH SCHOOL BOARD 

 

            BE IT ORDAINED by the City Council of the City of Thibodaux in regular session assembled, that:

 

            WHEREAS, in accordance with applicable state law, the municipalities and public entities of the Parish of Lafourche are mandated to appoint a single collection agency to collect all sales and use tax levied in the Parish; and

 

            WHEREAS, the Lafourche Parish School Board has been designated as the central collection agency for the Parish; and

 

            WHEREAS, it is necessary to execute an agreement with the Lafourche Parish School Board for the collection of the Sales and Use Tax for the City of Thibodaux; and

 

            WHEREAS, the said agreement will be for a period of two years, with the City paying the said board a commission of 0.90% for the collection services.

 

            NOW, THEREFORE BE IT ORDAINED by the City Council of the City of Thibodaux in regular session assembled, that the Mayor be and is hereby authorized to execute a two year sales tax collection agreement with the Lafourche Parish School Board at a commission of 0.90%.

 

            BE IT FURTHER ORDAINED that a copy of the said agreement is attached hereto as Exhibit “A” and thereby made a part hereof.

 

            The above ordinance having been submitted to a vote, the vote thereon was as follows:
